Estate Planning and Probate Administration
Cox Davis, LLP offers a full range of estate
planning and administration services. Attorneys Mike Tremblay and Scott Davis
co-chair the Estate Planning and Probate Administration Committee. We provide experienced advice, plan and
prepare documents and administer estates and trusts.
We represent a wide variety of estate planning
clients including individuals, estates, fiduciaries, owners of closely held
businesses, corporate executives, non-profit organizations, professionals and
families with special needs.
We
offer consultation and planning concerning issues confronting aging clients and
their families, especially when necessary to preserve family assets when an
aging client must enter a nursing home.
Our services include Wills, Trusts, Powers of
Attorney, Health Care Proxies, Homestead declarations, business succession
planning (including S corporations, C corporations, partnerships and limited
liability companies), life insurance planning, charitable giving programs such
as charitable remainder trusts; and asset protection plans such as family
limited partnerships. We take a
personalized approach to help our clients define their wealth transfer goals in
light of complicated legal and tax rules and design their plans to accomplish
those objectives. We are committed to informing clients of all the options
available to them, helping chose from among those options and ensuring that our
clients understand their estate plans and the practical impact on the
beneficiaries. In the case of high
net-worth clients and larger estates, we design our estate plans utilizing
marital deduction trusts, QTIP trusts, and credit shelter trusts to minimize or
eliminate estate taxes, optimize the preservation of a family’s accumulated wealth
and achieve philanthropic goals.
Our attorneys also have wide experience in
preparing and filing necessary petitions in the Probate and Family Court for
the probate of estates, guardianships, adoptions, name changes, and the like,
and to use disclaimers and effectuate elections to take optimal advantage of
post-mortem planning.
